Project Deck
Terms of Service
Version 2026-10-23.2 · Effective October 23, 2026. These Terms govern your use of projectdeck.net and the Project Deck marketplace, including customer, contractor, messaging, quote, project, review and beta features.
Clarified adult eligibility, quote acceptance and consumer rights, private-content use, proportionate suspension, liability and indemnity safeguards, and how future changes require agreement.
1. Agreement to these Terms
These Terms govern the Project Deck marketplace at projectdeck.net (the Service). Project Deck is the Service's trading name; references to Project Deck or its operator mean the person or entity operating the Service, not a contractor listed on it. No incorporated status or insurance coverage is represented by that name. Account holders agree by selecting the unchecked agreement box and submitting signup or renewed acceptance, not merely by visiting a public page. The version, acceptance time and account identity are recorded. These Terms apply to both homeowners/customers and contractors, including independent tradespeople and trades businesses. If you act for a business, you confirm authority to bind it. If you do not agree, do not create an account or continue using protected features. The Privacy Policy describes data handling; acknowledgement is not blanket consent to optional analytics or marketing. Highlighted sections contain important responsibility limits; please read them carefully.
2. Eligibility and accounts
The Service is for adults aged 18 or older who are legally capable of entering into binding agreements. Do not create or use an account if you are under 18. You must provide accurate information and keep credentials secure, notify Project Deck promptly of suspected unauthorized access, and take reasonable steps to protect your account. You are responsible for activity you authorize or cause; this does not make you automatically liable for every unauthorized action or remove Project Deck's own legal obligations. You may not impersonate a person or business, register for unlawful purposes, or use another person's account without permission. Project Deck does not represent that it has independently verified every user's age or identity.
3. Project Deck is a neutral marketplace, not the contractor
Project Deck is a neutral online marketplace and intermediary. It provides technology that helps customers and independent contractors or trades businesses find one another, exchange information, request and submit quotes, communicate, manage project status and leave reviews. Project Deck does not perform construction, plumbing, electrical, HVAC or other trade work and is not a party to any service contract between a customer and a contractor. Project Deck is not the employer, agent, partner, joint venturer, franchisor, insurer, guarantor or representative of any contractor or customer, and does not direct, supervise or control how work is performed. Customers and contractors independently negotiate and are responsible for scope, pricing, payment, schedule, safety, permits, qualifications, warranties and the resolution of any disagreement between them. This marketplace role does not remove Project Deck's own obligations under applicable law.
4. Independent contractor responsibility
Contractors are independent businesses or individuals and are solely responsible for the services they offer and perform, including workmanship, scope, pricing, estimates, scheduling, employees and subcontractors, taxes, permits, licences, registrations, insurance, bonding, workplace health and safety, building-code compliance and all other legal or professional requirements that apply to their work. Contractor profile statements, including any licences, registrations, insurance or bonding, are supplied by the contractor. Project Deck does not currently verify contractor licences, insurance or other credentials.
5. Customer responsibilities and due diligence
Customers are responsible for describing jobs accurately, deciding which contractor or trades business to hire, reviewing quotes and scope, maintaining a safe worksite and complying with obligations that apply to the property owner. Before hiring, customers should independently confirm any licence, registration, certificate or authorization required for the work, ask for proof of appropriate insurance and confirm it with the issuer or insurer, check references, and agree in writing on scope, price, payment terms, schedule and any warranty. Project Deck does not make the hiring decision for the customer, and a profile, badge, rating, review or self-reported statement is not proof of qualifications or coverage. Contractors should likewise take reasonable steps to confirm the job, site conditions and customer before starting work.
6. Quotes, hiring and payments
A quote, estimate, message or profile is supplied by its author. The Hire/accept-quote action records the selected contractor, updates project status and enables the hired-party interaction, including access to the private job address. It may have contractual consequences between those users depending on their agreement and applicable law, but does not make Project Deck a party or replace a legally required written contract. Project Deck does not currently collect project payments or hold funds in escrow, and does not guarantee payment or performance. Users independently agree scope, payment terms, taxes, change orders, schedule and warranties and must meet applicable disclosure, written-contract and cancellation requirements. Contractor quotes are not platform prices. Acceptance does not waive a consumer's statutory cancellation or other rights. Any future platform fee or payment service requires separate clear disclosure and agreement before charging; these Terms alone do not authorize it.
7. Addresses and private job information
Exact customer addresses and other private job details are not public listing information. Project Deck may disclose an exact job address to the contractor hired for that job so the parties can perform the project. Users must use private job information only for the legitimate project purpose and must not disclose, sell or misuse it.
8. No guarantee of users, services, credentials or insurance
Project Deck does not guarantee that a user is who they claim to be, that a contractor is licensed, registered, insured, bonded, qualified or suitable, that a customer will proceed with work or pay, that a quote will be accurate, or that any project will be safe, lawful, timely, code-compliant or satisfactory. Credential verification is not currently offered: Project Deck does not currently verify contractor licences, insurance or other credentials, and nothing on the Service should be read as verification, endorsement or certification of any user. Users should independently confirm information that matters to their decision.
9. Emergency and hazardous situations
Project Deck is not an emergency-response service. Do not rely on the platform for urgent threats to life, health, fire, gas, electrical safety, flooding, structural collapse or other emergencies. Contact emergency services, utilities or appropriately qualified professionals when circumstances require it.
10. User content
You retain ownership of submitted content. You grant Project Deck a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and process it only as reasonably necessary to operate, secure and improve the Service, consistent with the Privacy Policy and your intended audience. This does not authorize public promotion of private messages, quotes, exact addresses or private files, or override required consent. You must have the right to submit content and necessary permissions for identifiable people, property images and third-party materials. Do not upload unnecessary sensitive information or another person's confidential information. Users receiving personal information must protect it, use it only for the authorized marketplace purpose and comply with their own applicable privacy obligations. The licence ends when content is removed except for lawful retention, backups and records reasonably needed for legal, security or dispute purposes as described in the Privacy Policy.
11. Reviews and marketplace integrity
Reviews must reflect genuine experiences and may not be fabricated, purchased, manipulated, retaliatory, defamatory or used to extort another user. Project Deck may moderate, hide or remove content that violates these Terms, threatens safety, creates legal risk or undermines marketplace integrity.
12. Prohibited use
You may not use Project Deck for fraud, harassment, discrimination, unlawful work, credential misrepresentation, scraping, spam, malware, security testing without written permission, evasion of access controls, unauthorized collection of personal information, or interference with the Service. You may not attempt to access another user's private jobs, messages, addresses, files or account data.
13. Disputes between users
Disputes about work, quotes, payment, damage, delay, workmanship or conduct are between the customer and the contractor involved. Project Deck is not obliged to mediate or resolve them, although it may, at its discretion, review reports, provide relevant records where lawful, or act on Terms violations. Nothing in these Terms requires customers or contractors to give up any right or remedy they have against each other, including the right to bring a claim in court, to a tribunal or to a regulator.
14. Release for third-party work-related claims
To the fullest extent permitted by law, you release Project Deck and its operator from claims, demands and losses arising from work, services, products, conduct or omissions of another marketplace user, including property damage, personal injury, non-payment or defective work caused by that user. This release does not apply to liability arising from Project Deck's own negligence, wilful misconduct, fraud, breach of these Terms or breach of privacy or consumer-protection law, and does not limit any right that cannot lawfully be released.
15. Suspension and termination
Project Deck may restrict, suspend or terminate access when reasonably necessary and proportionate to protect users, investigate misuse, comply with law, enforce these Terms, secure the Service or change or end the open beta. Where reasonably practicable, it will provide notice and an opportunity to contact support; urgent safety, security or legal circumstances may require action without advance notice or disclosure of sensitive details. You may stop using the Service and request account closure through Settings or the Privacy Policy contact. Closure does not automatically erase records that may lawfully need retention or cancel obligations between users. Provisions that by their nature survive termination continue to apply only within their stated scope and applicable law.
16. Third-party services
The Service relies on third-party infrastructure and service providers for functions such as hosting, authentication, storage, email delivery, analytics and error monitoring. Project Deck is not responsible for third-party services outside its reasonable control, although Project Deck remains responsible for its own obligations under applicable privacy and consumer-protection law.
17. Disclaimer of warranties
To the maximum extent permitted by law, Project Deck is provided on an as-is and as-available basis, and Project Deck disclaims implied warranties and conditions, including merchantability, fitness for a particular purpose and non-infringement. Project Deck does not promise uninterrupted availability, error-free operation, a minimum number of jobs or contractors, successful hiring, a particular business result, or that every user-generated statement is accurate. Nothing in these Terms excludes a warranty, condition, right or remedy that cannot lawfully be excluded, including those under the Ontario Consumer Protection Act, 2002.
18. Limitation of liability
Subject to the exceptions below and to the maximum extent permitted by law, Project Deck and its operator exclude indirect, incidental, special, exemplary, punitive or consequential losses, lost profits, lost opportunities and loss of data arising from the Service. Claims caused solely by another user's work or conduct are addressed by section 14, not a release of Project Deck's own wrongdoing. Where liability may lawfully be limited, aggregate liability for all claims arising from the same event or related series of events, whether in contract, tort (including ordinary negligence) or otherwise, will not exceed the greater of CAD $100 or fees you paid directly to Project Deck in the 12 months before the first event giving rise to those claims; payments to contractors are not platform fees. Neither the exclusions nor the cap apply to fraud or fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by Project Deck's negligence, breach of applicable privacy law, or any liability, warranty, consumer right or remedy that cannot lawfully be limited or excluded. Section 20 controls where mandatory law requires a different result. These provisions allocate permitted platform-service risk; they do not promise immunity or limit users' claims against each other.
19. Indemnity
To the extent permitted by law, contractors must indemnify Project Deck and its operator against third-party claims and reasonably incurred damages and legal costs to the extent caused by their work, employees or subcontractors, failure to meet applicable permit, licensing or insurance obligations, misrepresentations or misconduct. Every user must likewise indemnify them to the extent a third-party claim is caused by that user's unlawful content, infringement, violation of law or material breach of these Terms. This is not an indemnity for Project Deck's own negligence, fraud, wilful misconduct, breach or unlawful data handling, nor for loss beyond the user's contribution or any consumer obligation prohibited by law. Project Deck must give reasonably prompt notice, allow reasonable participation in the defence and reasonably mitigate loss; delayed notice reduces obligations to the extent it causes prejudice. No settlement imposing an admission, non-monetary obligation or unreimbursed payment on the user may be made without the user's consent, not unreasonably withheld. Any contractor duty to defend is confined to covered third-party claims and these safeguards, not unlimited legal costs or unrelated claims.
20. Consumer and other non-waivable rights preserved
These Terms do not waive, limit or exclude any right or remedy that cannot be waived, limited or excluded under applicable law, including rights under the Ontario Consumer Protection Act, 2002 (the version currently in force), privacy law, the law of negligence and other mandatory statutes. Project Deck does not require mandatory arbitration and does not require users to waive participation in class proceedings. If a mandatory law conflicts with these Terms, that law controls to the extent of the conflict.
21. Notice of disputes with Project Deck
If you have a concern or claim involving Project Deck, please first send written notice through the contact methods on projectdeck.net describing the issue and the outcome you are seeking, so that Project Deck can try to resolve it informally. Project Deck will review the notice and respond within a reasonable time. This step is voluntary and does not restrict, delay or replace any right you have to go to court, a tribunal, a regulator or another forum provided by law.
22. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles, subject to any mandatory consumer-protection law of the place where you reside. Subject to any mandatory consumer rights or jurisdictional rules, disputes relating to Project Deck may be brought in the courts of Ontario.
23. Severability and interpretation
If any provision of these Terms is found invalid, unenforceable or inapplicable to you, it will be limited or severed only to the minimum extent necessary, and the remaining provisions continue in full effect. Headings are for convenience only. A failure to enforce a provision is not a waiver of it.
24. Changes to these Terms
Project Deck may propose updated Terms as the Service evolves. Each material revision has a distinct version and effective date and requires a notice through the Service identifying the principal changes and affirmative acceptance before continued access to protected pages. Merely browsing, silence or a preselected checkbox is not renewed acceptance. The prior published October 23, 2026 version remains available from the Terms page. You may decline, stop using protected features and request account closure; public Terms, Privacy and contact information remain available without agreement. Changes do not retrospectively alter accrued rights, earlier events, existing user-to-user service contracts or disputes arising before acceptance. Non-material corrections cannot reduce existing rights under an already accepted version.
25. Contact
Legal and account questions or notices may be sent to support@projectdeck.net or through the Contact page. Privacy questions and closure or data requests may be sent to privacy@projectdeck.net as described in the Privacy Policy. Project Deck may send necessary account, security and legal notices through the Service or your registered email; keep it current. These methods do not replace any formal service procedure or notice method required by law, and delivery failures do not override mandatory notice rights. Agreement to these Terms does not authorize promotional messages without a lawful consent basis.
