Terms of Service

Version 2026-10-23 · Effective October 23, 2026. These Terms govern your use of projectdeck.net and the Project Deck marketplace, including customer, contractor, messaging, quote, project, review and beta features.

Archived published version — not the current Terms.

Current TermsPrivacy Policy

1. Agreement to these Terms

By creating an account, accessing or using Project Deck, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not create an account or use the Service. If you use Project Deck for a business, you confirm that you have authority to bind that business to these Terms. Sections shown with a highlighted border contain important limits on Project Deck's responsibility; please read them carefully.

2. Eligibility and accounts

You must be legally capable of entering into binding agreements and provide accurate account information. You are responsible for activity under your account and for keeping login credentials secure. You may not impersonate another person or business, create an account for unlawful purposes, or use another person's account without permission.

3. Project Deck is a neutral marketplace, not the contractor

Project Deck is a neutral online marketplace and intermediary. It provides technology that helps customers and independent contractors or trades businesses find one another, exchange information, request and submit quotes, communicate, manage project status and leave reviews. Project Deck does not perform construction, plumbing, electrical, HVAC or other trade work and is not a party to any service contract between a customer and a contractor. Project Deck is not the employer, agent, partner, joint venturer, franchisor, insurer, guarantor or representative of any contractor or customer, and does not direct, supervise or control how work is performed. Customers and contractors independently negotiate and are responsible for scope, pricing, payment, schedule, safety, permits, qualifications, warranties and the resolution of any disagreement between them. This marketplace role does not remove Project Deck's own obligations under applicable law.

4. Independent contractor responsibility

Contractors are independent businesses or individuals and are solely responsible for the services they offer and perform, including workmanship, scope, pricing, estimates, scheduling, employees and subcontractors, taxes, permits, licences, registrations, insurance, bonding, workplace health and safety, building-code compliance and all other legal or professional requirements that apply to their work. Contractor profile statements, including any licences, registrations, insurance or bonding, are supplied by the contractor. Project Deck does not currently verify contractor licences, insurance or other credentials.

5. Customer responsibilities and due diligence

Customers are responsible for describing jobs accurately, deciding which contractor or trades business to hire, reviewing quotes and scope, maintaining a safe worksite and complying with obligations that apply to the property owner. Before hiring, customers should independently confirm any licence, registration, certificate or authorization required for the work, ask for proof of appropriate insurance and confirm it with the issuer or insurer, check references, and agree in writing on scope, price, payment terms, schedule and any warranty. Project Deck does not make the hiring decision for the customer, and a profile, badge, rating, review or self-reported statement is not proof of qualifications or coverage. Contractors should likewise take reasonable steps to confirm the job, site conditions and customer before starting work.

6. Quotes, hiring and payments

A quote, estimate, message or profile on Project Deck is information supplied by the user who created it. Accepting a quote creates a relationship between the customer and contractor, not with Project Deck. Unless a Project Deck feature expressly says otherwise, Project Deck does not collect project payments, hold funds in escrow, guarantee payment or guarantee performance. Users are responsible for agreeing on payment terms, taxes, change orders, warranties and any written contract needed for the work, including any contract formalities required by consumer-protection law.

7. Addresses and private job information

Exact customer addresses and other private job details are not public listing information. Project Deck may disclose an exact job address to the contractor hired for that job so the parties can perform the project. Users must use private job information only for the legitimate project purpose and must not disclose, sell or misuse it.

8. No guarantee of users, services, credentials or insurance

Project Deck does not guarantee that a user is who they claim to be, that a contractor is licensed, registered, insured, bonded, qualified or suitable, that a customer will proceed with work or pay, that a quote will be accurate, or that any project will be safe, lawful, timely, code-compliant or satisfactory. Credential verification is not currently offered: Project Deck does not currently verify contractor licences, insurance or other credentials, and nothing on the Service should be read as verification, endorsement or certification of any user. Users should independently confirm information that matters to their decision.

9. Emergency and hazardous situations

Project Deck is not an emergency-response service. Do not rely on the platform for urgent threats to life, health, fire, gas, electrical safety, flooding, structural collapse or other emergencies. Contact emergency services, utilities or appropriately qualified professionals when circumstances require it.

10. User content

You retain ownership of content you submit, such as job descriptions, photos, portfolio images, messages and reviews. You give Project Deck a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and process that content only as reasonably necessary to operate, secure, improve and promote the Service, consistent with the Privacy Policy. You represent that you have the right to submit the content and that it does not violate law or another person's rights.

11. Reviews and marketplace integrity

Reviews must reflect genuine experiences and may not be fabricated, purchased, manipulated, retaliatory, defamatory or used to extort another user. Project Deck may moderate, hide or remove content that violates these Terms, threatens safety, creates legal risk or undermines marketplace integrity.

12. Prohibited use

You may not use Project Deck for fraud, harassment, discrimination, unlawful work, credential misrepresentation, scraping, spam, malware, security testing without written permission, evasion of access controls, unauthorized collection of personal information, or interference with the Service. You may not attempt to access another user's private jobs, messages, addresses, files or account data.

13. Disputes between users

Disputes about work, quotes, payment, damage, delay, workmanship or conduct are between the customer and the contractor involved. Project Deck is not obliged to mediate or resolve them, although it may, at its discretion, review reports, provide relevant records where lawful, or act on Terms violations. Nothing in these Terms requires customers or contractors to give up any right or remedy they have against each other, including the right to bring a claim in court, to a tribunal or to a regulator.

14. Release for third-party work-related claims

To the fullest extent permitted by law, you release Project Deck and its operator from claims, demands and losses arising from work, services, products, conduct or omissions of another marketplace user, including property damage, personal injury, non-payment or defective work caused by that user. This release does not apply to liability arising from Project Deck's own negligence, wilful misconduct, fraud, breach of these Terms or breach of privacy or consumer-protection law, and does not limit any right that cannot lawfully be released.

15. Suspension and termination

Project Deck may restrict, suspend or terminate access when reasonably necessary to protect users, investigate misuse, comply with law, enforce these Terms, protect the Service or run the open beta. You may stop using the Service at any time. Provisions that by their nature should survive termination, including release, liability, indemnity, intellectual-property and dispute provisions, continue to apply.

16. Third-party services

The Service relies on third-party infrastructure and service providers for functions such as hosting, authentication, storage, email delivery, analytics and error monitoring. Project Deck is not responsible for third-party services outside its reasonable control, although Project Deck remains responsible for its own obligations under applicable privacy and consumer-protection law.

17. Disclaimer of warranties

To the maximum extent permitted by law, Project Deck is provided on an as-is and as-available basis, and Project Deck disclaims implied warranties and conditions, including merchantability, fitness for a particular purpose and non-infringement. Project Deck does not promise uninterrupted availability, error-free operation, a minimum number of jobs or contractors, successful hiring, a particular business result, or that every user-generated statement is accurate. Nothing in these Terms excludes a warranty, condition, right or remedy that cannot lawfully be excluded, including those under the Ontario Consumer Protection Act, 2002.

18. Limitation of liability

To the maximum extent permitted by law, Project Deck and its operator will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses, lost profits, lost opportunities or loss of data, or for property damage, bodily injury or disputes arising from work performed by marketplace users. Where liability may lawfully be limited, Project Deck's aggregate liability arising from the Service will not exceed the greater of CAD $100 or the fees you paid directly to Project Deck during the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by Project Deck's negligence, fraud or fraudulent misrepresentation, wilful misconduct or gross negligence, breach of privacy law, or rights under the Ontario Consumer Protection Act, 2002 or other mandatory consumer law.

19. Indemnity

To the extent permitted by law, contractors agree to defend, indemnify and hold Project Deck and its operator harmless from third-party claims, losses, damages and reasonable legal costs arising from their own work, services, employees or subcontractors, permits, licensing or insurance obligations, misrepresentations, or misconduct. To the same extent, every user agrees to indemnify Project Deck for third-party claims arising from that user's content, breach of these Terms, violation of law or infringement of another person's rights. This indemnity is reduced to the extent a loss was caused by Project Deck's own negligence, wilful misconduct or breach, and does not require any consumer to indemnify Project Deck where the law does not permit it.

20. Consumer and other non-waivable rights preserved

These Terms do not waive, limit or exclude any right or remedy that cannot be waived, limited or excluded under applicable law, including rights under the Ontario Consumer Protection Act, 2002 (the version currently in force), privacy law, the law of negligence and other mandatory statutes. Project Deck does not require mandatory arbitration and does not require users to waive participation in class proceedings. If a mandatory law conflicts with these Terms, that law controls to the extent of the conflict.

21. Notice of disputes with Project Deck

If you have a concern or claim involving Project Deck, please first send written notice through the contact methods on projectdeck.net describing the issue and the outcome you are seeking, so that Project Deck can try to resolve it informally. Project Deck will review the notice and respond within a reasonable time. This step is voluntary and does not restrict, delay or replace any right you have to go to court, a tribunal, a regulator or another forum provided by law.

22. Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles, subject to any mandatory consumer-protection law of the place where you reside. Subject to any mandatory consumer rights or jurisdictional rules, disputes relating to Project Deck may be brought in the courts of Ontario.

23. Severability and interpretation

If any provision of these Terms is found invalid, unenforceable or inapplicable to you, it will be limited or severed only to the minimum extent necessary, and the remaining provisions continue in full effect. Headings are for convenience only. A failure to enforce a provision is not a waiver of it.

24. Changes to these Terms

Project Deck may update these Terms as the Service evolves. If a change is material, Project Deck will provide reasonable notice and, where appropriate, require acceptance of the new version before continued use of affected features. Changes do not apply retroactively to disputes that arose before the change.

25. Contact

Legal questions about these Terms may be sent to Project Deck through the contact methods provided on projectdeck.net. Privacy questions should be directed as described in the Privacy Policy.
